Abstract:

One of the administrative contract type that targets long time use of public services by a franchisor in a corporation which is private law legal person, is franchise contract. It is said franchising supplier one party of contracting parties, other party corporation franchisor. In accordance with contract formed with administration franchisor owns every debit, capital, profit, harm and loss. This contract fronts us as one of the public services’ colour form. Although public service is implemented macro size on many fields of government it is also implemented micro size on local administration. Both in the fifteenth clausewith the titel of “authorities and franchises of municipal” the municipal law no 5393 and in the seventh clause of metropolitan municipality law no 5216 it is accepted that municipalities can form a contract on particular subjects
