Abstract:

A violation of the law defined as a fact or a behavior prohibited by the law may disappear in certain circumstances if the conditions provided for by the law are met. The main of these are the consent of the injured, public security and superiority of private or public benefit. When the agreement element is examined along with the circumstances that eliminate the other violation of law, it is faced with various situations where the violation of law is discussed whether it will disappear or not. It is important to know who has given or who has given it. Furthermore, the superior benefit from other circumstances does not always ensure the elimination of the violation of law, especially in cases such as the conflict of the right to the protection of the privacy of public interest and private life. With this study, first of all the subject will be briefly addressed as the basic element of the subject, then the consent of the person damaged from the cases that remove the law will be examined by the types of consent. According to the lighting burden, the importance of the applicable consent within the framework of the health law will be emphasized. Also, the subject of consent will also be addressed under the rights. Subsequently, top-quality special interest and top-quality public interest issues will be analyzed. There will be a dispute between personal rights and public interests. The article is aimed at seeking answers to the question of how the balance of conflicting interests can be achieved by addressing both the Turkish law and other laws and legal regulations.
