Karayolları Motorlu Araçlar Zorunlu Mali Sorumluluk (Trafik) Sigortası Genel Şartları, 14 Mayıs 2015 tarih ve 29355 Sayılı Resmi Gazetede yayınlanarak 1 Haziran 2015 tarihinde yürürlüğe girmiştir. Daha sonra 2 şubat2 ve 2 Ağustos 20163 tarihlerinde yapılan değişikliler ile Karayolları Motorlu Araçlar Zorunlu Mali Sorumluluk (Trafik) Sigortası Genel Şartlarına son şekli verilmiştir. Genel şartlar ile getirilen bu değişiklikler ve özellikle destekten yoksun kalma taleplerine ilişkin olanlar 2918 sayılı Karayolları Trafik Kanununda da değişiklik yapılmasını gerektirmiştir. Bu bağlamda 2918 sayılı Karayolları Trafik Kanununda da önemli değişiklikler yapılmıştır. Karayolları Motorlu Araçlar Zorunlu Mali Sorumluluk (Trafik) Sigortası Genel Şartlarının bazı maddelerinin iptali için Ankara Barosu tarafından açılan dava sonucunda da, Danıştay 15. Dairesi, 27 Haziran 2018 tarihinde oybirliğiyle bir takım maddelerin iptaline karar vermiştir. Çalışmamızda, anılan Tebliğ ve Kanun ile trafik sigortası alanında yapılan değişiklikler ve getirilen yenilikler ele alınacaktır.
Highway Motorized Vehicle Compulsory Liability Insurance (Traffic Insurance) General Conditions were published on the Official Gazette dated 14 May 2015 and numbered 29355 and entered into force on 1 June 2015. Later on February 2 and August 2, 2016, amendments were made to the General Conditions of the Highway Motorized Vehicle Compulsory Liability Insurance (Traffic Insurance). These changes brought about by the general conditions and especially those related to the requests for deprivation of support necessitated the amendment of the Road Traffic Legislation number 2918. Significant changes have also been made in the Road Traffic Legislation No. 2918 in this context. As a result of the lawsuit filed by the Ankara Bar Association for the cancellation of certain articles of the General Conditions of Traffic Insurance, the 15th Chamber of the Council of State unanimously decided to cancel a number of articles on 27 June 2018. In our work, changes and innovations introduced in the field of traffic insurance will be discussed with the mentioned communication and Road Traffic Legislation.
