Bu çalışma, Avrupa İnsan Hakları Mahkemesi kararlarının kişisel verilerin korunması hakkına sağladığı katkıları aktarmak amacıyla hazırlanmıştır. Avrupa İnsan Hakları Sözleşmesinde kişisel verilerin korunmasına ilişkin doğrudan bir hüküm olmamasına rağmen AİHM, Sözleşme’nin 8. maddesi kapsamında yaptığı değerlendirmeler sonucunda kişisel verilerin korunmasına bir hukuki değer atfetmiştir. Nitekim AİHM kararları, kişisel verilerin korunmasının hukuken korunan bir “hak” olarak tanımlanması bakımından Avrupa Birliği Hukukuna ve üye ülkelerin iç hukukundaki yasal düzenlemelere önemli katkılar sunmuştur.
This study was prepared to transfer the contribution that the European Court of Human Rights decisions provide to the right to the protection of personal data. Although there is no direct provision in the European Convention on Human Rights concerning the protection of personal data, the AIFM has assigned a legal value to the protection of personal data as a result of its assessments under Article 8 of the Convention. In fact, the decisions of the AIMM have made significant contributions to the European Union law and to the legal regulations in the national law of the Member States in terms of the definition of the protection of personal data as a "right" protected by law.
This study was prepared in order to convey the contribution of the European Court of Human Rights judgements’ to the protection of personal data. Although there is no direct provision in the European Convention on Human Rights for the protection of personal data, the ECHR has cited a legal value for the protection of personal data as a result of its assessments under Article 8 of the Convention. As a matter of fact, the ECHR judgments have made significant contributions to the European Union Law and to the legal regulations in the internal law of the member states in order to define the protection of personal data as a legally protected “right”.
