Bu çalışmanın konusunu, bir sözleşmede yer alan kuralların ne zaman genel işlem şartları olarak görülebileceği ve 6098 sayılı Türk Borçlar Kanunu’nda bu kurallar için öngörülen denetimlerden teşmil ve yürürlük denetimleri oluşturmaktadır. Bu sorular bağlamında çalışmada ilk olarak, genel işlem şartları kavramının unsurları üzerinde durulmaktadır. Takiben, kanunda öngörülen denetim mekanizmasına değinilmektedir. Bununla beraber çalışmada, kanunda öngörülen denetim mekanizmasının tamamı değil, bu mekanizmanın belirli bir bölümü olan teşmil ve yürürlük denetimleri incelenmektedir. Esasen Türk Öğretisinde tek başlık altında incelenen bu denetimler, çalışmada birbirinden ayrılmıştır. Kanunda bu denetimleri aşamayan sözleşme kuralları için yazılmamış sayılma sonucu bağlanmıştır. Taraflar açısından bu kurallar çerçevesince bağlamazlık sonucunun hukuki sınıflandırması da yine çalışmada incelenmektedir.
The subject of this study is when the rules contained in a contract can be viewed as general transaction conditions and the inspections and validity of the inspections provided for for for these rules in the Turkish Debt Act No. 6098. In the context of these questions, the study first focuses on the elements of the concept of general processing conditions. The control mechanism is provided for by the law. However, in the study, not the whole of the audit mechanism provided by the law is examined, but the performance and validity audits, which are a particular part of this mechanism. Basically, these audits under one title studied in Turkish teaching, are separated in the study. The law is linked to the unwritten counting result for the contractual rules that do not exceed these checks. In the context of these rules, the legal classification of the outcome of non-compliance is also examined again in the study.
