6306 Sayılı Afet Riski Altındaki Alanların Dönüştürülmesi Hakkında Kanun bireylerin temel hak ve hürriyetlerine ağır sınırlamalar getirmekle birlikte maliki olduğu yapıyı yenilemek isteyen yapı malikleri için önemli maddi destekler de sağlamaktadır. Arsa payı karşılığı inşaat sözleşmesi imzalayarak yapısını yenilemek isteyen bir yapı sahibinin kanunun öngördüğü desteklerden de faydalanarak kendi tercih ettiği bir yüklenici ile yapısının yenilenmesini sağlaması mümkündür. Bunun için öncelikle yapının riskli olduğunun tespit edilmesi, ardından yıktırılması ve taşınmazın tapu sicilinde arsa haline gelmesi gerekir. Bu aşamada arsa paylarının doğru bir şekilde arsa sahiplerine tahsis edilmesi önemlidir. Çünkü arsa sahipleri arsa payı karşılığı inşaat sözleşmesi imzalanıp imzalanmayacağına arsa payı oranların göre karar vereceklerdir. Kanun kapsamındaki yükümlülüklerini, süreleri, karar alınması için gereken asgari çoğunlukları bilmeyen yapı sahiplerinin yıkım sonrası arsa paylarını kamulaştırılması derecesine varan olumsuz sonuçlarla karşılaşması olasıdır
Transformation of Areas Under the Disaster Risk Act No.6306 provides noticeable financial aid to the building owners who want to renew their buildings, even if it severely restricts the fundamental rights and freedom of individuals. It is possible for a building owner who wants to make a construction contract in return for the land share with a contractor that is chosen by the building owner himself, to use the aid which is provided under this Act. For this purpose, first it should be confirmed that is the building has a risk, after that building should be demolished and turn into land on the title deed. At this stage it is important to assisgn land share to land owners correctly. Because the land owners will decide whether a consctruction contract in return for landshare is to be drawn or not with the majority of their land shares. If building owners are not aware of the obligations, legal periods, majority rules that they should comply with according to the provisions of this act, it is likely for them to encounter with negative outcomes to the degree of losing their land share as a result of expropriation by state.
