So many results that aren't mine?

Abstract:

Montreux Antlaşması’nda Türkiye’nin yargı hakkı düzenlenmemiştir. Montreux Antlaşması’nda Türkiye’nin yargı hakkının açıkça düzenlenmemiş olması, boğazlardan geçen yabancı gemilerin haczedilip edilemeyeceği sorununu ortaya çıkarmıştır. Ayrıca Türkiye’nin boğazlardan geçen yabancı gemilere el koyma hakkının bulunup bulunmadığı da tereddüt edilen diğer bir konudur. Çalışmamızda her iki konu Montreux Antlaşması’nda yer alan hükümler ile 1958 Karasuları ve Bitişik Bölgelere İlişkin Cenevre Konvansiyonu ve 1982 Birleşmiş Milletler Deniz Hukuku Konvansiyonu kapsamında ele alınacak; doktrindeki farklı görüşlere ve muhtelif mahkeme kararlarına yer verilecektir.
