Çalışmanın konusu, Milletlerarası Mal Satımına İlişkin Sözleşmeler Hakkında Birleşmiş Milletler Anlaşması ışığında hasar sorununun incelenmesi ve Türk Borçlar Kanunu ile arasındaki bağlantının karşılaştırmalı olarak değerlendirilmesidir. Bu açıdan, ilk olarak hasar kavramı üzerinde durulmuş, ayrıca edim hasarı ve karşı edim hasarı kavramları açıklanmıştır. CISG, hukuk düzleminde doğuşuna kadar olan sürede Roma Hukuku, İsviçre Hukuku, Fransız Hukuku ve Alman Hukuku gibi birçok hukuk sisteminden etkilenmiştir. Bu sebeple söz konusu hukuk sistemlerinde hasar sorununa getirilen çözüm yolları üzerinde durulmuştur. Çalışmanın önemli bir kısmı ise hasar sorununu düzenleyen CISG m. 66-70 hükümlerinin incelenmesine ayrılmıştır. Son kısımda ise CISG’ın öngördüğü hasarın geçişi sisteminin Türk Hukuku ile ilişkisi karşılaştırmalı olarak aktarılmıştır.
The subject of the study is the comparative assessment of the issue of damage in the light of the United Nations Agreement on Contracts relating to the International Sale of Goods and the link between the Turkish Debt Act and the United Nations Treaty on International Sale of Goods. From this point of view, the concept of damage was first focused on, and the concepts of action damage and counter action damage were also explained. CISG has been influenced by many legal systems, such as Roman law, Swiss law, French law and German law, until its birth. This is why the legal system has been focused on the solutions to the problem of damage. A significant part of the study was dedicated to the examination of the CISG 66-70 provisions that regulate the damage problem. In the last part, the transition system of damage provided by the CISG is comparable to the Turkish law.
