Şer’iyye Sicilleri, kadılar tarafından yapılan yargılamalar sonucu verilen hükümlerin kaydedildiği defterlerdir. Bu siciller, şehir ve bölge tarihçiliği açısından birinci elden kaynak hükmündedir. Özellikle çalışma konumuzu kapsayan aile yapısı ve kadının toplumsal statüsü bağlamında da detaylı bilgiler içermesi hasebiyle bu kayıtlar önem arz etmektedir. Günümüzde yaygın bir kanaat olan Osmanlı toplumunda hakim olan çok eşlilik ve çocuk sayısının fazlalığı yanında kadına biçilen rolün toplumda söz söyleme hakkının olmaması, zorla evlendirilmesi ve tek işinin çocuk doğurmakla sınırlandırılmasıdır. Yanlış olarak bilinen bu algının XVIII. asrın başlarına tesadüf eden döneme ait Kayseri Şer’iyye Sicilleri’ne dayalı olarak yaptığımız incelemelerde Osmanlı İmparatorluğu’na bağlı bir sancak olan Kayseri’de bu şekilde olmadığı göze çarpar. Tek eşliliğin hakim olduğu, çok eşliliğin istisna olmakla beraber, çocuk olmadığında gerçekleştiği terekelerdeki alacak ilamlarından tespit edilebilmektedir. Kadının da toplum içerisinde söz sahibi olduğu, sahip olduğu hakları da yine bu kayıtlardan öğrenilebilmektedir.
