Kasten öldürme suçu, korunan hukuki değer yaşama hakkı olduğundan, tüm ceza kanunlarında yer alan bir suçtur. Söz konusu suç Türk Ceza Kanunu’nun 81 vd. maddelerinde ve Alman Ceza Kanunu’nun 211 vd. maddelerinde düzenlenmiştir. Alman ceza hukuku, birçok ülkeyi olduğu gibi, Türk ceza hukukunu ve doktrinini de etkilemektedir. Bu yüzden kasten öldürme suçunun incelenmesinde de, Alman ceza hukukundaki yaklaşımları bilmek önem arz etmektedir. Bu çalışmada, klasik suç tipi incelemesi usulü izlenerek, kasten öldürme suçu açısından Türk ve Alman ceza kanunlarının karşılaştırmalı bir incelemesi yapılmıştır.
