Abstract:

Makalenin konusu, Türk hukukunda iddianamenin iadesi kurumudur. Bu kapsamda çalışmada öncelikle, soruşturma evresinin işleviyle bağlantı kurmak suretiyle 1412 sayılı Ceza Muhakemeleri Usulü Kanunu döneminde ilk soruşturmanın kaldırılmasından sonra yaşanan sorunlar, iddianamenin iadesi kurumuna duyulan ihtiyaç ve getirilen çözüm önerileri açıklanmıştır. Daha sonra Türk Hukuku ile sınırlı olmak üzere iddianamenin iadesinin şartları, yasak olduğu haller, usulü ve sonuçları çok yönlü bir bakış açısıyla tartışılmaya çalışılmıştır.
