Bu çalışmada hukuk ve muhasebe bilim dalı bağlamında, hukuk fakültesi ders müfredatında muhasebe dersinin gerekliliği irdelenmiştir. 6102 Sayılı Türk Ticaret Kanunu’nun (TTK) genel gerekçesi beşinci paragrafında, uluslararası piyasaların bir parçası olmak hedefi ortaya konulmuştur. Hedefe ulaşmak için, finansal tabloların uluslararası standartlara göre düzenlenmesi gerekliliğine yer verilmiştir. Buna göre, TTK’da finansal tablolar, ticari defterler bölümünde 68 ilâ 81. maddeleri arasında ve Anonim Şirketler Dokuzuncu Bölümünde, Şirketin Finansal Tabloları ve Yedek Akçeler başlığı altında 514 ilâ 528. maddeler arasında açıkça düzenlenmiştir. TTK’da muhasebeye ilişkin temel kurallar da yer almaktadır. Bununla birlikte vergi hukukunda, ticari defterlerin neler olduğu, finansal tabloların nasıl tutulacağı ve vergiye esas alınacak karın ne şekilde belirleneceğine ilişkin kurallar bulunmaktadır. Ayrıca Hukuk Muhakemeleri Kanunu’nda ticari defterlerin delil olarak kullanılmasına dair düzenlemeler mevcuttur. Bu kanunlarda birçok düzenleme bulunmasına rağmen, ilgili derslerin bazılarında bu konuların esası anlatılamamakta, bazılarında ise konular hiç işlenmemektedir. Muhasebe, hukuk alanının dışında görülmektedir. Yapılan kanuni düzenlemeler muhasebe bilgisine sahip olmadan yapılmaktadır. Bu bağlamda önerimiz ilgili muhasebe derslerinin hukuk fakültesi müfredatına konulmasıdır. Muhasebe dersi, hukuk fakültesinde genel muhasebe olarak ikinci sınıfta verilmeye başlanmalıdır. Zira ikinci sınıfta vergi hukuku, üçüncü sınıfta ticaret hukuku dersleri verilmektedir. Bu derslerin anlaşılabilmesi için ikinci sınıfta verilmesi gereklidir. İkinci sınıfta ikişer saatlik zorunlu ders olarak, iki dönemde de yer almalıdır. İlk dönem “Genel Muhasebe I” dersi verilmelidir. Bu derste ticari defterlerin neler olduğu ve tutulması konuları bulunmalıdır. İkinci dönem “Genel Muhasebe II” dersi programa konulmalıdır. Bilanço, gelir tablosu, kar dağıtım tablosu ve nakit akış tablosu bu dersin kapsamında ele alınmalıdır. Ayrıca dördüncü sınıfta seçimlik ders olarak “Karın Hesaplanması ve Dağıtımı” konulmalıdır. Zira üçüncü sınıfta şirketler hukuku dersi alınmaktadır. Bu seçimlik ders sayesinde şirketler hukukunda eksik kalan kısımlar tamamlanacaktır.
In this study, the necessity of accounting course in law school course curriculum is examined in the context of law and accounting. In the fifth paragraph of the general justification of the Turkish Commercial Code No. 6102 (TCC), the objective is to be a part of international markets. In order to reach the target, it is necessary to arrange the financial statements according to international standards. Accordingly, in the Turkish Commercial Code, financial statements are clearly regulated in Articles 68 to 81 of the business books section and 514 to 528 under Tab Financial Statements and Reserves. Section of the Joint Stock Companies section. Basic rules of accounting are also included in the TCC. In addition to this, there are rules in the tax law on what are the commercial books, how to keep the financial statements and how to determine the taxable profit. There are also regulations on the use of books as evidence in the Code of Civil Procedure. Although there are many regulations in these laws, in some of the related subjects the essence of these subjects cannot be explained, while in some of them the subjects are not processed at all. In this context, when the curricula of the faculty of law are examined, suggestions have been made about when the accounting course should be given and compatible with the other courses.
