Materfamilias kavramı, fonetik karşılığı olduğu düşünülebilen paterfamilias kavramından içerik olarak bütünüyle ayrılmaktadır. Hukuki bir anlam taşıyan ve hukuki bir kurum olan ailenin temelinde yer alan paterfamilias’ın aksine, materfamilias yalnızca, kadının iffetini ve saygınlığını esas alan, bu nedenle iffetli ve saygın kadınlara tanınan sosyal imtiyazdan ibaret olan bir terimdir. Bununla birlikte, bu toplumsal gerçeklik, hukuk metinlerinde de kendisine yer edinmiş; hukukçular materfamilias’ın anlamı üzerinde durmuş, bu kavramın neleri kapsadığına ilişkin açıklamalar yapmışlardır. Bunun yanı sıra, bu imtiyaza sahip kadınların ve saygınlıklarının toplum içerisinde hukuken korunmasına özen gösterilmiştir. The concept of Materfamilias is completely separated from the concept of paterfamilias, which can be considered a phonetic reward. Unlike paterfamilias, which has a legal meaning and is a legal institution, which is the foundation of the family, materfamilias is a term that is merely a social benefit that is based on the female affection and respect, and is therefore recognized to the affectionate and respected women. However, this social reality has also taken its place in the legal texts; the lawyers have stood on the meaning of materfamilias, and have made explanations about what this concept covers. In addition, women with this privilege and their respects are protected by law within the society. In this context, inuria and lex Iulia de Adulteriis Coercendis should also be evaluated by materfamilias.
