Türkiye’de sigortalılık statüsü açısındanheterojen grubu kendi adına ve hesabına çalışanlar oluşturmaktadır. 5510 sayılı Sosyal Sigortalar ve Genel Sağlık Sigortası Kanunu’nun 4. maddesinin 1. fıkrasının b bendine göre, ticari kazancı nedeniyle gelir vergisi mükellefi olanlar, esnaf ve sanatkârlar, şirket ortakları ve tarımsal faaliyette bulunanlar kendi adına ve hesabına bağımsız çalışanlar olarak tanımlanmaktadır. Bu grubunönemli özelliği kendi faaliyetlerinden dolayı elde ettikleri gelirin düzensiz ve belirsiz oluşudur. Bu nedenle düzenli prim ödeme alışkanlıklarızayıf olan sigortalı gruplarından birini oluşturmaktadır. Bu anlamda, kendi hesabına çalışanların sosyal koruma yetersizliği ile karşılaşma olasılığı diğer sigortalı gruplarına göre oldukça fazladır. Bu çalışma, Türkiye’de kendi adına ve hesabına çalışanların gelir düzeyleri ve yaşam standartları ile sosyal güvenlik sistemi arasındaki ilişkiyi ve sosyal güvenlik programlarından ne ölçüde yararlandıklarını saptamayı amaçlamaktadır. Çalışmada, kendi adına ve hesabına çalışanların sosyoekonomik koşulları Türkiye İstatistik Kurumu mikro verilerinden yararlanarak hesaplanmıştır. Yapılan analizler sonucunda, kendi hesabına çalışanların gelir durumu ile sosyal sigortaya kayıtlılık arasında doğru yönlü bir ilişki olduğu, kendi hesabına çalışanlarınaz 1/3’ünün prim borcu nedeniyle sağlık hizmetlerinden yararlanamadığı, sosyal sigorta edimlerine hak kazanmanın kolaylığı nedeniyle kendi hesabına çalışma statüsünden bağımlı çalışmaya geçişlerin yaşandığı bulgulanmıştır.
In Turkey, in terms of insurance status, the heterogeneous group forms employees on their own behalf and account. In accordance with Article 4(1)(b) of the Social Insurance and General Health Insurance Act No. 5510, those who are taxed on income due to commercial profits, traders and artists, corporate partners and those who are in agricultural activity are defined as independent workers on their behalf and account. The important feature of this group is the unregular and uncertainty of the income they earn due to their own activities. Therefore, the regular premium payment habits form one of the insured groups that are poor. In this sense, the likelihood of employees in their own account to encounter deficiency of social protection is much higher than other insurance groups. This study aims to determine the relationship between income levels and living standards and the social security system and the extent to which they benefit from social security programs. In the study, the socio-economic conditions of employees on their own behalf and account were calculated using the micro data of the Turkish Statistical Bureau. The results of the analyses found that the employee’s income status and social insurance registration have a correct relationship, that 1/3 of the employee’s account cannot benefit from health services due to primary debt, that the facility of earning the right to social insurance benefits has resulted in transitions from the employment status to the employee’s account.
