Abstract:

By opening critical debate to relations between “ethical” and “political” general amnesty has potential to remove crime and punishment and to make past events be forgetten. It has been used by mant countries in order to provide social reconciliation; especially in times of political transitions. Europe has been one of the locations as an example for general amnesty took place, where human rights violations-originating form conflictful processes and authoritariantotalitarian regions-were observed. European Court of Human Rights, as the most important supranational court of Europe, set more sensitive approaches to above mentioned general amnesty practices. While it directed adverse approaches to them before. It claimed that amnesty practices aiming at seeking of social reconciliation don’t vioalte European Convention of Human Rights
