Abstract:

Courts break off their judicial activities for 42 days annually for the period of June 20th to August 31th in Turkey due to the judicial vacation. As a prohibition of working is ruled by law, no trails are heard in this period of the year except for some urgent works being handled by vacation judges and prosecutors. Legal terms are extended to post vacation if the last day of these terms to fall on this period. It has been stated that judicial vacation leads to substantial loss of efficiency and undue delay beyond the reasonable time in judicial services. The duration of judicial vacation was amended subsequently in 2005 and 2012 due to these arguments. However, removing this practice from the law has not been considered so far. It should be abolished, instead of changing the number of days at times. This article analyzes the inefficiency that judicial vacation causes, the reasons justifying the annulment of this period of term, and possible troubles and solutions in case of such annulment by referring to the comparative legal practices
