The right to congregate and demonstrate is envisaged under Article 11 of the European Convention on Human Rights and Article 34 of the Turkish Constitution. This right which has increasing importance in pluralist democracy is one of the basic rights which shape the democratic society.Two problems stand out in connection with the cases which the ECHR hears regarding Turkey on the ground of Article 11 of the Convention. The first one is the intervention in peaceful meetings and demonstrations, for which no prior permission is obtained, with direct use of force without any tolerance. The second one is the disproportionate use of force by police forces to disperse the participants.Dispersion of those who exercise the right to congregate and demonstrate brings a set of problems. Disproportionate use of force in exercise of this right leads to suppression and silencing of people as well as to force them not to participate in other platforms anymore where they can express their opinions. It also violates Article 3 of the Convention and the right to life and not be tortured.The priority should be given to training for personnel and to awarenessraising activities so as to ensure that ECHR does not find Turkey in violation
