Adalet hizmeti, toplumsal düzenin sağlanması adına en önemli kamusal hizmetlerden biridir. Devlet, adalet hizmetinin sunulması adına kamu harcaması yaparak iktisadi bir hizmet alanı olan ‘adalet ekonomisini’ oluşturmaktadır. Tam kamusal hizmet niteliğine sahip olan adalet hizmeti, devlet tarafından kamu harcamaları yapılarak topluma sunulmaktadır. Adalet hizmeti harcamaları olarak nitelendirdiğimiz bu harcamalar Adalet Bakanlığı bünyesinde tahsis edilen ödenekler yanında, yüksek yargı teşkilatına tahsis edilen merkezi yönetim bütçe ödeneklerinin ilgili yüksek mahkemeler tarafından kullanımı da, adalet harcaması olarak nitelendirilecektir. Adalet hizmeti harcamalarının kamu mali yönetimi ilkeleri olan etkililik ve verimlilik ilkelerine uygun olarak gerçekleştirilmesi adalet harcamaları bakımından büyük önem arz etmektedir.
