Tarihsellik, “bir hükmün belirli bir tarihi, coğrafi ve sosyal ortamda mevcut olması, onun varlığı ve devamının bu şartların varlığı ve devamına bağlı bulunmasıdır.” Sünnette tarihsellik/ yerellik denilince Hz. Peygamber’in söz, davranış ve eylemlerine yansıyan, kendi dönemine özgü tarihsel, bölgesel, sosyal, siyasal, kültürel ve ekonomik özellikler akla gelir. Sünnet yaşanmış uygulamalar olarak kabul edilir. Bu uygulamalar içinde yer aldıkları toplumun zihinsel, dilsel ve yaşamsal pratiklerini yansıtır. Allah’ın elçisi bir peygamber olarak daha önce benzeri görülmemiş yeni bir toplum inşa etmiş ve yeni değerler ve uygulamalar başlatmıştır. Nihayetinde bunu Miladi VII. yüzyılın başındaki Arap Yarımadası’nın toplumsal zemininde başarmıştır. Bu tespit Hz. Peygamber’in sünnetinin çağımıza ulaşan verileri demek olan hadislerin anlaşılması ve anlamlandırılması fıkhî açıdan yorumlanması için oldukça mühimdir. Daha somut olarak ifade etmek gerekirse, Hz. Peygamber’in içinde yer aldığı olayların kaydedildiği hadis koleksiyonlarındaki bilgilerin -her ne kadar bunların bir kısmı Hz. Peygamber’in ağzından kaydedilmiş olsa da- VII. yüzyıl Arap toplumunun söylem ve algılarından bağımsız okunması yanlış anlaşılmalara mahal verecektir. Rivayetlerin vermek istedikleri mesaj açısından evrensel bir yönünün olmasının yanı sıra kişilerin özel halleriyle ilgili veya bilgi ve beceri isteyen meselelerle alakalı hadislerin tüm topluma ait bir mesaj içermesi de gerekmez. Sünnette evrensellikten anlaşılan şey ise hadis ve sünnetin beşeriyete ait bir mesaj içermesidir. O iletiye tabi olunduğunda da Hz. Peygamber’in önemsediği maksadın tahakkuk etmesidir. Günümüzde sünneti çağa taşımak için atılması gereken adımlardan biri de sünnette yerellik ve evrensellik konusunun doğru anlaşılmasıdır. Bu çerçevede bu makalede, fıkhî açıdan sünnetin yerel ve evrensel yönü ele alınacaktır.

As a messenger of God, as a prophet he raised unprecedented individuals, built a new society, and introduced new values and practices, but ultimately he did so in the VII century succeeded on the social ground of the Arabian Peninsula at the turn of the century. What is understood from universality in sunnah is that hadith and sunnah contain a message belonging to humanity. It is the realization of the purpose that the Prophet cares about when he is subject to that message. One of the steps to be taken in order to bring circumcision into the modern age is to understand the issue of locality and universality in circumcision correctly. In this context, in this paper, the local and universal aspects of circumcision will be discussed.
