In this article the issue of the legitimacy of the Constitutional Court is examined. The view of the way the constitutional justice is legitimate is based on the principle that the laws cannot be contrary to the constitution. The legitimacy of the constitutional judgment cannot be explained by this principle. For it is not clear whether a law is contrary to the Constitution, it is evident in itself. It is decided by commenting whether a law is contrary to the Constitution. In a system where the Constitutional Court is presented, this comment is made by the Constitutional Court. In a system where there is no constitutional court, this opinion is made by the legislative body. It is impossible to prove that the interpretation of the Constitutional Court is more accurate than the interpretation of the legislative body. The interpretation of the law enforcement body and the interpretation of the Constitutional Court may also be wrong. Zira, the interpretation of the Constitution is not a "process of knowledge" but a "process of will". In other words, the interpretation of the Constitution is not in the "space of knowledge" but in the "space of will". In a democracy, in a field that requires will, the decision-making authority belongs not to the judges, but to the representatives of the people or the people.
