İslam Hukukunda Hapis Cezası Çeşitleri ve Süreleri

Abstract:

Tarih boyunca suç sayılan fiiller bütün toplumlar ve inançlar tarafından yasaklanmış,  çiğnenmesi halinde ise kişiler cezalandırılmıştır. Tarihin her döneminde kurallara uyan kitleler olduğu gibi, onu ihmal ve ihlal edenler de var olmuştur ve olacaktır. Bunun için suç işleyenlere belli cezai müeyyideler ön görülmüştür ki bunlardan biri de hapistir. Hapis cezası, İslam hukukunda da var olan hürriyeti bağlayıcı cezalardan biridir.  Bu makalede İslam hukuku açısından hapis cezasının çeşitleri ve süresini ele aldık.

Abstract:

Certain acts/behaviors that have been counted as an offense throughout history have been forbidden by all societies and beliefs, and persons have been punished in the case of violation. There have been and will be the masses who obey the rules, as well as those who neglect and violate these rules, in every period of history. Therefore, some certain penal sanctions have been determined for criminals, and one of them is imprisonment. Imprisonment, which also exists in Islamic law, is one of the penalties restricting personal freedom. In this study, we have discussed the types and duration of imprisonment in terms of Islamic law.
