1940-1981 yılları arasında çeşitli gerekçelerle Batı Trakya ve Kıbrıs'tan Türkiye’ye gelen göçmenler, terk ettikleri ülkelerde eğitimini aldıkları çoğu meslek ve sanatın yalnızca Türk vatandaşlarına hasredildiğini görmüşler ve ekonomik sıkıntı içine düşmüşlerdir. Bu olumsuz durumun ortadan kaldırılması amacıyla, 1981 yılında 2527 sayılı Kanun çıkartılmış ve Türk soylu yabancılara çalışma izni almak kaydıyla Türk vatandaşlarına hasredilmiş iş ve meslekleri de icra edebilme imkânı sağlanmıştır. Bu çalışmada, Kanun ile kurulan sistemin zaman içerisinde amaç ve konu yönlerinden önemli bir değişim geçirdiği ve bu değişim neticesinde kanun koyucunun iradesi ile uyumlu olmayan yeni bir kapsamın ortaya çıktığı tezi işlenecektir. Çalışmanın ilk bölümünde, sistem ana hatları ile tanıtılacaktır. Bu kapsamda, Türk soylu yabancı kavramı üzerinde durulacak, Türk soylu yabancılara tanınan temel ayrıcalıklar, onlardan beklenen temel yükümlülükler ve söz konusu sistemin yürürlüğe girdiği tarihten sonra yaşanan olaylar bağlamında üstlendiği rol ve öneme temas edilecektir. İkinci bölümde ise, sisteme yeniden bakılacak, kanun koyucunun güttüğü amaç üzerinde durulacak ve gerek sistematik gerek yerindelik yönlerinden eleştiri konusu yapılmaya müsait hususlar ele alınacaktır. Bu kapsamda sistemin amacı, konusu ve yabancılar hukukumuzdaki yeri hakkında çeşitli değerlendirmeler yapılacaktır.
Between the years of 1940 and 1981, Turkic foreigners who were coming to Turkey as immigrants/refugees primarily from Western Thrace and Cyprus have soon realized the fact that their previous occupations were exclusively confined to Turkish citizens in their new country. This obstacle, which led so many of them into financial troubles was removed by the enactment of Act no: 2527 in 1981. This legislation allowed Turkic foreigners to practice their previous occupations as long as they can provide a valid working permit. In this paper, it will be argued that the system established by the Act has gone through a change over the years, both in terms of its purpose and subject matter, thereby resulting in a new scope of application which is non-compliant with the original intent of its drafters. In the first part, the concept of Turkic foreigner, alongside with the main privilages and duties being entrusted will be examined. Then, the historical role of the entire system will be remembered. In the second part, an emphasis will be given on the original intent of the drafters and some problematic aspects will be introduced, only to be followed by our own conclusions about how to understand the purpose and the subject matter of the Act and its categorical position within the general framework of Turkish Law of Foreigners.
