Abstract:

Companies are one of the most important players in the modern-day free market economy. It is a known fact that, companies, who aim to maximize their profits, don’t always achieve these goals through legal procedures. They resort to the illegal means in some cases. In this context, frequently some companies are established which known as “front company” in practice and it is intended to generate an income mainly or absolve the value of assets caused by crime. No wonder, it can’t be thought that any rule of law allow such a situation. However, when the importance of the companies in economical and social life is considered, interventions which will be made to the companies must be treated with great precision. Therefore, with the article 133 of Turkish Penal Procedure Code (TPPC), “Appointing a Trustee For The Administration of a Firm” has entered to our Turkish legal system and thus, it is aimed to prevent some negative situations experienced in the past in our country. In our study, the subject “Appointing a Trustee For The Administration of a Firm” will be analyzed with main lines and comments and suggestions will be made
