Asgari işçilik uygulaması, işverenin yaptığı işin emsaline, nitelik, kapsam ve kapasitesine göre işini yürütebilmesi için gerekli olan sigortalı sayısının, çalışma süresinin ve prime esas kazanç tutarının altında bildirimde bulunduğunun Sosyal Güvenlik Kurumunca saptanması halinde, kanuni ölçütler dikkate alınarak işin yürütülmesi için gerekli olan işçilik miktarının saptanmasıdır. Asgari işçilik uygulaması her işveren ve her işyeri için ayrı ayrı yapılır. İhaleli işler ve özel nitelikteki inşaat işlerinde, işverenin asgari işçilik tutarından daha az bir bildirimde bulunup bulunmadığı Sosyal Güvenlik Kurumu ünitesi tarafından dosya üzerinden araştırılır. Diğer işlerde asgari işçilik uygulaması sadece Sosyal Güvenlik Kurumu müfe􀄴 işlerince yapılır. Bu uygulamanın nasıl yapılacağı Sosyal Güvenlik Kurumunun düzenleyici işlemleri ile belirlenmektedir. Bu çalışmada asgari işçilik kavramı, 506 sayılı Sosyal Sigortalar Kanunundan 5510 sayılı Sosyal Sigortalar ve Genel Sağlık Sigortası Kanunu dönemine dek geçirdiği değişikliklerle beraber detaylı olarak açıklanmıştır.
