Bu araştırmada Ankara ilinde suça sürüklenmiş olan 165 çocuk üzerinden bir değerlendirme yapılmıştır. Bu bağlamda çocukların ve ailelerin sosyo-demografik özellikleri, çocukların ve ailelerin suç kayıt durumu, çocukların ne tür suçlara karıştığı ve çocuklara yönelik ne gibi koruyucu ve destekleyici tedbir kararı alındığı gibi çeşitli hususlara yer verilmiştir. Çocukların annesinin suç kayıt durumuna bakıldığında annelerin %33,3’ünün babaların %47,3’ünün daha evvel bir suç olayına karıştığı görülmektedir. Suça sürüklenen çocukların kardeşlerinin suça sürüklenme durumu incelendiğinde kardeşlerin %34,5 oranla daha evvel en az bir kere suç eyleminde bulunduğu görülmektedir. Bu nedenle ailelerin çoğunda bir suç kültürü geliştiği ve çocukların da model alma yoluyla suça karıştıkları söylenebilmektedir. Çocukların %92,7 oranla daha evvel suça karıştığı ve suç işlemede mükerrer davrandıkları görülmektedir. Çocukların, hırsızlık (%26,1), kavga (%22,4), kasten yaralama (%17,5), uyuşturucu kullanımı, bulundurma veya satışı (%6,6), Tehdit-hakaret (%4,8) suçlarına karıştıkları görülmektedir. Çocuklara suç olgusuna dair bu fikir nereden aklınıza geldi diye sorulduğunda çocukların %65’inin suç davranışını çevreden gördüğünü ifade etmiştir. Yüzde 44’ü ise cahillik, sinir, tartışma ve kimseden, kendimden gibi yanıtlar vermiştir. Çocukların az bir kısmı %3,5 suçu aile ve akrabalarından gördüğünü ifade etmiştir. Bu çocukların model alsa da, ailelerini koruyan bir yaklaşımına işaret etmektedir. 5395 sayılı Çocuk Koruma Kanunu kapsamında hakkında koruyucu ve destekleyici tedbir kararı verilen çocuk sayısı 13’tür (%7,8). Bu nedenle çocuklara verilen tedbir kararlarının sınırlı olduğu görülmektedir. Çalışmada bu sonuçlara ilişkin çeşitli öneriler getirilmektedir.
This study has been evaluated by 165 children who have been convicted in the province of Ankara. In this context, the socio-demographic characteristics of children and families, the status of the crimes of children and families, what kind of crimes children are involved and what protective and supporting measures against children are taken. If the child’s mother’s crime record is seen, 33.3 percent of the mothers and 47.3 percent of the fathers are involved in a previous crime. When the investigation of the situation of the brothers and sisters of the children who were tortured, it is estimated that 34.5 percent of the brothers and sisters had been tortured once earlier. Therefore, it can be said that many families develop a crime culture and that children are also involved in crime through modeling. 92.7 per cent of children have previously committed crimes and behaved misleading. Children are found to be involved in the crimes of theft (26.1 percent), struggle (22.4 percent), deliberately injury (17.5 percent), drug use, holding or sale (6.6 percent), threat-hate (4.8 percent). When asked how this idea of the crime came to your mind, 65% of children said they saw the crime behavior from around. And 44 percent gave answers like ignorance, nervousness, discourse, and anyone. Less than 3.5 percent of children said they saw the crime from their families and relatives. Though these children take the model, they indicate a approach that protects their families. The number of children granted protection and support measures within the framework of the Child Protection Act No. 5395 is 13 (7.8%). Therefore, the measures given to children are limited. There are several recommendations on these results.
