1982 Anayasasının 148. maddesinin birinci fıkrası, Olağanüstü Hallerde (OHAL) çıkarılan Kanun Hükmünde Kararnamelerinin (KHK) şekil ve esas bakımından Anayasaya aykırılığı iddiasıyla Anayasa Mahkemesinde dava açılamayacağını düzenlemektedir. Bu hükme rağmen Anayasa Mahkemesi, 1991 yılından itibaren OHAL KHK’larının Anayasaya uygunluğunun yargısal denetimini yapmıştır. 15 Temmuz 2016 sonrası ilan edilen OHAL süresince çıkarılan OHAL KHK’larının iptali istemiyle açılan davalarda ise Mahkeme, içtihadını değiştirerek, açılan iptal davalarını yetkisizlik nedeniyle esasa girmeksizin reddetmiştir. Anayasallık denetimi yapılamayan OHAL KHK’larının tamamı Türkiye Büyük Millet Meclisince (TBMM) kanunlaşmak suretiyle onaylanmış ve bunların iptali talebiyle tekrar dava açılmıştır. Bu makalede Anayasa Mahkemesi içtihadında henüz örneği olmayan bu denetimin nasıl yapılabileceği araştırılmaktadır.
Article 148(1) of the Constitution of 1982 provides that the provisions of the Constitution of the Republic of Lithuania and of the Constitution of the Republic of Lithuania in the Extraordinary Cases (OHAL) may not be brought to the Constitutional Court for the claim of violation of the Constitution in terms of form and principle. Despite this ruling, the Constitutional Court has since 1991 carried out judicial inspection of OHAL KHK’s conformity to the Constitution. In the cases opened with the request for the cancellation of the OHAL KHKs issued during the OHAL period after 15 July 2016, the Court, by changing its drinking, rejected the cancellation cases opened due to the lack of authority. All of the OHAL KHKs that cannot be carried out constitutional inspection have been approved by the Greater National Assembly of Turkey (TBMM) by legislation and have been re-opened with a request for their cancellation. In this article, the Constitutional Court is investigating how this inspection can be done without an example yet.
Article 148 of the Constitution of the Republic of Turkey states that decrees having the force of law issued during a state of emergency shall not be brought before the Constitutional Court alleging their unconstitutionality as to form or substance. Despitethis prohibition of judicial review of the decrees having the force of law, the Constitutional Court madejudicial review of them since 1991. The Court has changed its jurisprudence and rejected claim of unconstitutionality of the decrees having the force of law issued after July 15th 2016 state of emergency due to the lack of venue. The Grand National Assembly of Turkey approved all of the decrees andappealed to the Constitutional Court for the annulment of them again. In this study, the method of judicial review of such decrees having the force of law is investigated
