Agency contract is one of the transaction contracts which is regulated under articles 502-514 of the Turkish Code of Obligation, therefore it is a typical conract type and also that is used in practice often. It takes place between agent and principal and the agent, undertakes to conduct principal’s certain business or provide certain services in accordance with the terms of the contract. Besides, fee is not an essential subject of this contract, so parties can determine a fee for the agent’s service, it is optional. In this circumstances whether get paid by principal or not, agent always have some obligations due to the agency contract and one of the them is, duty of care. General principles and aspects about indicating agent’s duty of care and the legal consequences of its breach constitutes main scope of this article
