Abstract:

In democracies, which are a regime of pluralism and transparency, as in all rights and freedoms, the freedom of expression and the freedom of the media, which is a specific appearance, is adopted as a principle in the legal system. The fact that the freedom of expression and the freedom of media can be restricted in mandatory and exceptional circumstances, under the condition of the conservation of the multiplicity and transparency aspects of the regime, is a general approach accepted by all democratic law states. Media, in other words, the press, has a great role and influence in all communities. Today, in addition to its traditional forms, many new forms of information and communication have been added to the media with the spread of the internet. While this situation has brought new benefits to society, it has brought some problems with it. In the doctrine and practice of human rights law, many of the rights are not unlimited. Freedom of speech and freedom of media are among these rights. In other words, the freedoms of expression and the freedoms of media are not an absolute (unlimited) right, and it is generally recognized at the global level that every contemporary democracy has developed a set of restrictions on these freedoms. Like freedom of expression and the freedom of the media, the limitation of these freedoms is one of the important factors that determine whether a society is democratic.
