Osmanlı Devleti, kurduğu sağlam siyasi düzen sayesinde uzun asırlar varlığını sürdürmüştür. Bu gerçekte, nitelikli devlet adamları ve padişahların karizmatik varlıklarının etkisi büyüktür. Fakat söz konusu devlette, hayata ve insanlara olumlu, yapıcı katkılar yapan Osmanlı insanlarının yanında, olumsuz ve yıkıcı tahribatlarla var olmuş zararlı unsurlar da görülmüştür. Bu bağlamda Osmanlı tarihi, her zaman ve her yerde olduğu gibi, biraz da suç ve ceza tarihidir. Çünkü devleti ayakta tutan temel faktörlerden birisi de, adaleti sağlamadaki hassasiyetidir. Bu da, devlet tarafından, bir yönüyle, suçlularla başa çıkma şeklinde yerine getirilebilir. Suç ve ceza tarihinde en çok çalışmış konuların başında fiziksel suçlar gelmektedir. Bu çalışmada, bir Osmanlı kazası olan Rusçuk’ta XVIII. yüzyılda işlenen adam yaralama ve öldürme suçları, şer’iyye sicillerinin verdiği bilgiler doğrultusunda incelenecektir. Böylelikle, cinayet mefhumunun Osmanlı tarihi üzerinden aydınlatılması hedeflenmiştir.
The Ottoman state, thanks to its strong political order, has continued its existence for many centuries. In fact, the influence of charismatic assets of qualified state men and princes is great. But in the state in question, along with the Ottoman people who have made positive, constructive contributions to life and people, there have also been harmful elements that have existed with negative and devastating destruction. In this context, the Ottoman history, as always and everywhere, is a bit of the history of crime and punishment. Because one of the main factors that keep the state standing is the sensitivity in ensuring justice. This can also be accomplished by the state, in a way, in the form of dealing with criminals. In the history of crime and punishment, the top subjects of physical crimes come. In this study, a Ottoman accident in Rusçuk XVIII. The crimes of injury and murder of the man committed in the century will be investigated according to the information their records give to the sherry. Thus, the purpose of the murder was to illuminate the murder from the Ottoman history.
Ottoman Empire has lasted for centuries by means of durable political order that established by him. The beings of qualitive state men and charismatic sultans are important effects for this reality. However, besides Ottoman people make positive conributions to the life and the others, dangerous people also has seen making negative and harmful destructions. In this context, Ottoman history, as every where and every time, is a crime and punishment history a little. Because, one of the factors sustained the state for a long time is sensibility of it for justice. This can be just done as overcomig against criminials for state. The most worked issues studied in crime and punishment history are phyisical crimes. In this study, bodily harm and muredering at Ruse in the XVIII. century will be searched in accordance with informations given by court registers. By this way, to approach murdering issue from Ottoman history will be is targeted.
