Modern ceza hukukunda kusursuz suç ve ceza olmaz ilkesi mevcut olup esas olarak sorumluluk kusura dayanır. Günümüzde objektif sorumluluk anlayışı terk edilmiş ve kusur sorumluluğu kabul edilmiştir. Buna göre kusursuz kişinin cezalandırılması mümkün değildir ve fail fiilinden ancak kusuru oranında sorumludur. Türk Hukuku’nda ve Mukayeseli Hukuk’ta objektif sorumluluk hipotezlerinin ortadan kaldırılmasına yönelik çalışmaların olduğu görülmektedir. Kasten işlenen bir suçun sonucu olarak meydana gelen başka ya da ağır neticeden failin ancak taksir seviyesinde bir kusurunun varlığı halinde sorumlu tutulabildiği ve temel suça göre daha ağır cezanın verilmesini gerektiren suçlar sonucu nedeniyle ağırlaşmış suçlar olarak adlandırılır.765 sayılı Eski Türk Ceza Kanunu’nda bu suçlara ilişkin genel bir hüküm yer almamaktaydı ve doktrinde bu suç tiplerinin birer objektif sorumluluk şekli olduğu kabul edilmekteydi. Objektif sorumluluğa yol açabilecek düzenlemelerin kanunlardan çıkarılması düşüncesi Türk Ceza Kanunu’na da yansımıştır.2005 yılında yürürlüğe giren 5237 sayılı Türk Ceza Kanunu’nun 23.maddesiyle genel bir hükme yer verilmiştir. Çalışmamızda sonucu nedeniyle ağırlaşmış suçlar bakımından, en azından taksir düzeyinde kusurun aranmasını gerektiren bu düzenlemenin objektif sorumluluğa dair ortaya çıkan tüm sorunların çözümünde yeterli olup olmadığı incelenmiş, istenmeyen neticeden sorumlulukla ilgili kusur ilkesi kapsamında meydana gelebilecek sorunlar ve çözümleri tartışılmış, söz konusu suçlarda sorumluluk kriterlerinin ortaya koyulması amaçlanmıştır.
In modern criminal law, the principle of perfect crime and no punishment exists and is basically based on responsibility forgiveness. Today, the concept of objective responsibility has been abandoned and defective responsibility has been accepted. According to this, the perfect person is not possible to be punished and the fault is only responsible for the fault rate. In the Turkish Law and the Comparative Law there are studies aimed at eliminating objective liability hypotheses. The Ancient Turkish Criminal Law No. 765 had no general provision concerning these crimes and the doctrine was considered these types of crimes as an objective form of liability. The idea of removing regulations that may lead to objective liability from the law has also reflected in the Turkish Criminal Code.The article 23 of the Turkish Criminal Code No. 5237, which entered into force in 2005, provides a general provision. In terms of crimes that have been aggravated due to the result of our study, the objective responsibility, which requires the search for a defect at least at the tax level, is considered to be sufficient for the solution of all problems arising from this regulation, the problems and solutions that may arise within the framework of the defect principle related to the responsibility of unwanted consequences, the objective is to identify the criteria of responsibility in the crimes concerned.
