Abstract:

The concept of khabar is mentioned by fiqh scholars as a a word which may be true but also but also possibly a lie due to its nature. In the manner of conveying the news, it is divided into two parts: mutawatir and ahåd. While there is almost no debate about the validity of the mutawatir news and the possibility of abrogation with it among methodology scholars, there is also a debate about the validity of the ahad news and the possibility of abrogation with it. In addition to these discussions, the concept of abrogation has been described in different ways in the methodology sources. One of these definitions is “the abrogation of a shar’i ruling by a similar shar’i ruling that emerged later, and the definition is more accepted. In this sense, the issue of abrogation accepted in this sense has been a matter of debate in the fiqh procedure, as stated above. While some methodology scholars, such as Ibn Hazm from the Zahiris and Tufi from the Hanbalis, accepted the abrogation of the Quran and the mutawatir sunnah with ahâd news as absolute, some other scholars rejected it absolutely. They made a distinction between the period of the Prophet Muhammad and after. While they accept the realization of abrogation with the news of the unity in the time of the Prophet, they do not accept it later periods. In this study, these approaches mentioned abovewill be evaluated through their justifications.
