Yapılan çalışmanın amacı, sportif alanın en önemli unsurlarından olan spor kulüpleri hakkında genel bilgiler vererek, spor kulüplerinin ülkemizdeki hukuki yapılanması ve bu yapılanmanın kulüplere getirdiği statüyü irdelemek, bu bağlamda kulüplerin sorunlarını ortaya koyarak değerlendirmek, elde edilen veriler ışığında öneriler geliştirmektir. Çalışmada konuya ilişkin genel bilgiler literatürün ve özellikle konuyla ilgili kanun, statü, yönetmelik ve talimatlar ile diğer mevzuatın taranmasıyla sistematik biçimde toplanarak değerlendirilmiş, kulüplerin karşılaştıkları sorunlarla ilgili örnekler de göz önünde bulundurularak konu hakkında kavramsal bir çerçeve oluşturulmuştur. Çalışma neticesinde elde edilen veriler bir bütün olarak değerlendirildiğinde, hukukun düzenleyici rolüne sportif alanda da mutlak ihtiyaç duyulduğu, sporun her unsuruna eşit mesafede olacak ve spor ruhuna uygun bir spor hukuk sisteminin geliştirilip, bu sistemde spor kulüplerine ayrı ve özel bir yer verilmesi gerektiği görülmektedir. Ülkemizde kulüplerle ilgili mevzuatta günümüz şartlarına ve uluslar arası spor mevzuatına uygun değişiklikler yapılmakla beraber bunların yeterli olmadığı, kulüplerin halen birçok sorununun mevcut mevzuattan kaynaklandığı ancak, problemlerin kaynağının sadece yasalar olarak görülemeyeceği, tüzel kişiliğe sahip kulüplerin kendi kişisel tercihleri ve uygulamalarının da pek çok soruna kaynak teşkil ettiği açıktır. Ülke sporunda başarısının artması ve spor etiğinin yerleşebilmesi için kulüplerin kendi özeleştirilerini yaparak uygulama ve tercihlerini gözden geçirmesi, konu ile ilişkili hususlarda araştırmalar yapılması ve tüm sportif unsurların bir araya gelmesiyle günün şartlarına uygun hukuki düzenlemelerin bir an evvel gerçekleştirilmesi gerektiğini söylemek mümkündür.

The aims of this study are to examine the legal settlement of the sports clubs in our country and the status that the clubs acquire through the mentioned settlement via providing general information about the sport clubs, which are one of the most important components of the sporting arena, to set forth the problems that the sports clubs are faced with in this context and to develop suggestions in the light of information obtained. In the study, general information regarding the issue has been collected and evaluated in a systematic manner surveying the related literature, periodicals and the related law, statuory decree, regulation, bylaws and other laws, regulations and a conceptual framework regarding the issue has been constructed as well taking the examples with respect to the problems that the clubs are faced with into consideration. On the basis of the examinatioon of the data resultant of the study as a whole, it can be concluded that the regulatory role of the law is also an absolute neccesity in sporting arena, that in this context it is requiered to develop a legal sytem that will respond all areas of sports equivalently and that will be in conformity with the spirit of sports. Although amendments in the laws regarding sports clubs has been introduces in accordance with the current conditions, international sport laws and regulations these proved not to be sufficient that most of the problems of the clubs stil arise due to laws but that the only source of the problems of the sports clubs are not the laws, it is clear that that the individual preferences and practices of incorporated clubs as well lead several problems. In order to improve the achievements of the country in sports arena and to be able to establish sports ethic clubs should apply self-criticism and revise their practice and preferences, studies on the issues related to the subject should be conducted and legal arrengements conforming to course of the present era considering all sports-related elements should be introduced as soon as possible.
