Abstract:

Public Interest has meaning of the philosophy, social, legal, technique, executive, also is used in administration and political sciences frequently. Public interest has ethic and ideological dimensions and therefore, we encounter difficult concept frame. Public interest does not evaluate only administrative law or philosophical approaches but also evaluate social concept affected by changes in public space. The conception of public interest taken place in the whole legal systems from Ancient Greece to the present time requires centralization of public interest in the process of producing policy by politicians by examining thoroughly in the new perspective. In this article, conception of the Award Decision of Public Utilities having a legal basis and its historical development have been examined expropriation and urgent expropriation processes, and conception of best public interest and urgency have been evaluated by researching Constitutional Court and Council of State thoroughly. Afterwards, three different decrees of the council of ministers have been studied theoretically and practically and it is revealed how Award Decision of Public Utilities should be implemented.
