Abstract:

تسعى هذه المقالة للتعريف بالعالم نظام الدين عمر بن علي المرغيناني )بعد 600 ه - 1204 م( المشهور بابن صاحب الهداية وبكتابه "جواهر الفقه"، هذا الكتاب الذي جمع فيه عددًا من مختصرات الحنفية وأغلبها مفقود، وقام بترتيبها على ترتيب كتاب والده الهداية. فالمقالة تذكر أهم النسخ المخطوطة الموجودة في تركية، ثم تتعرض للمقدمات المذكورة في الكتاب، ثم أسلوب مؤلفه في الشرح وعرض المسائل، وطريقته في الاستدلالات والترجيحات، مع تتبع مصادره التي استقى منها كتابه، ثم خاتمة تبين أهمية هذا الكتاب في الفقه الحنفي، وتلقي الضوء أيضاً على مؤلفات علماء ما وراء النهر في القرن السابع الهجري.
