Türk hukuk mevzuatında ağaç ve ağaççıkların zarar görmesi konusunda mevzuat incelendiğinde konunun orman sınırı içinde kalan ağaç ve ağaççıklar için özel bir düzenleme orman sınırı dışında kalan ağaç ve ağaççıklar için ayrı bir düzenleme yapıldığı görülmektedir. Orman sınırı içinde kalan ağaç ve ağaççıkların zarara görmesi esnasında mevzuat uygulamaları ve düzenlemelerin yerleşik hal aldığı görülmesine rağmen orman sınır dışında kalan ve özellikle kent içi alanlarda bulunan ağaç ve ağaççıkların zarar görmesi sonucundaki değerlendirmelerde belirsizlikler ve sorunlar olduğu anlaşılmaktadır. Özellikle kent içi alanlarda ağaç ve ağaççıkların gerek sahipleri gerekse sahibi olmayanlar tarafından kesilmesi neticesinde yaşanan tartışmalar ve bu durumun yargıya taşınmasında yapılan araştırma neticesinde artış olduğu gözlenmektedir. Çatışmanın tarafları irdelendiğinde ise ağırlıklı olarak durumun site ve apartman sakinleri ile site ve bina yöneticileri arasında olduğu gibi belediyeler ile mahalde yaşayan vatandaşlarında hasım oldukları görülmektedir. Olayın bir diğer tarafı ise Orman İdareleri olmakta özellikle kesilen ağacın orman ağacı olması sebebiyle izin prosedürü işletilmekte ve bu izin prosedürünün de hukuki açıdan değerlendirilmesi de bir başka konu olarak karşımıza çıkmaktadır. Çalışmanın temelini oluşturan hukuksal dayanaklar ise, bu konuya dair tartışmaya açılması gereken bir diğer husustur. Bu bağlamda özellikle 5237 Sayılı Türk Ceza Kanunu ve 6831 Sayılı Orman Kanunun önceliği konusunda kanunların yarışmasının mevcut hükümler ve hukukun genel prensipleri dahilinde irdelenmesi gerekmektedir. Çalışma da ayrıca İstanbul ilinde kent içi alanlarda ağaç kesilmesine dair incelenen yerel mahkeme kararları ve sonuçları da ayrıca değerlendirilerek sonuç ve öneriler sunulmaya çalışılacaktır.
In the Turkish law, when the legislation on the damage of trees and trees is examined, it is seen that a special arrangement for the trees and trees left within the forest border is made for the trees and trees left outside the forest border. In particular, in urban areas, the debate is observed as a result of the cutting of trees and trees by those who need or don’t own, and this situation is increased as a result of the research conducted in the transfer to court. When the parties to the conflict are resolved, it is apparent that the situation is mainly in the local and apartment residents and the site and building managers, as well as in the municipalities and citizens living in the neighborhood. The other side of the incident is the Forest Administration, especially because the cut tree is a forest tree, the permit procedure is operated, and the legal assessment of this permit procedure is also another subject. The legal foundations that make up the basis of the study are another subject to be discussed on this subject. In this context, the competition of laws on the priority of the Turkish Criminal Law No. 5237 and the Forest Law No. 6831 must be carried out within the current provisions and the general principles of the law. The study will also try to present results and recommendations by evaluating local court decisions and results examined on the cutting of trees in the urban areas in the province of Istanbul.
