Abstract:

Liquidation of the abandoned property of displaced and disappeared persons since 1915 by a court order and recording the revenue thereof as an income to the Budget are being rediscussed within the framework of interference with a property right, currently. The claims to the right of property within the context of abadoned property requires to be assessed by both internal law and litigation in European Court of Human Rights (ECHR) perspectives. The purpose of this Article is to evaluate claims to the right of property within the context of procedural possibilities in relation to the ECHR. Primarily, the status of the cases pertaining to the right of property before the ECHR is described. The possible outcomes of the prospective claims before the ECHR an right to property within the context of abandoned property is assessed thereupon
