Aile, hem huzur, sükûn, sevgi ve fedakârlık yeri hem de yeni nesillerin eğitim ve terbiyesinin sağlandığı yerdir. Toplumun temeli ve en küçük yapı taşı olan aileyi koruyamayan toplumlar dağılmaya ve yok olmaya mahkûmdurlar. İslâm hukukunda aileyi oluşturmanın yegâne yolu olan evlilik, fıtri bir ihtiyaç kabul edilmekte ve teşvik edilmektedir. İslâm’da, evliliğin rastgele ve geçici değil devamlılık ve mutluluk temeli üzerine kurulması hedeflenmektedir. Ailenin devamlılığını sağlamaya yönelik olarak bir taraftan geçici evlilikler haram kılınırken diğer taraftan da nikâh öncesi, evlilik devam ederken, boşanma öncesi, boşanma esnasında ve sonrasında bazı tedbirler ve hükümler öngörülmüştür. Mutluluk ve devamlılık üzere bir ailenin oluşturulması hedeflenmekle beraber bazen aile hayatında uyuşmazlıklar ve anlaşmazlıklar olabilmektedir. Bu anlaşmazlık durumlarında da meşru bir gerekçe bulunmadan kolaycılığa kaçarak hemen boşanmaya başvurulmamalı, boşanma son çare olarak görülmeli ve anlaşmazlıkların çözümüne ve evliliğin devamına yönelik tedbirler uygulanmalıdır. Son çare olarak başvurulan boşanma, ileride dönüşü mümkün olmayacak şekilde evliliği sona erdiren bir çözüm biçiminde değil eşlere düşünme fırsatı verecek ve ileride pişmanlıklara bağlı olarak evlilik hayatına geri dönmeyi mümkün kılacak şekilde yapılmalı ve aceleye getirilmeyip zamana yayılmalıdır. Biz daha önceki bir bildirimizde ailenin devamlılığına yönelik evlilik öncesi tedbirleri ele aldığımız için bu makalemizde ailenin devamlılığına yönelik olarak aile devam ederken, boşanma öncesinde, boşanma esnasında ve boşanma sonrasındaki tedbir ve hükümleri inceleyeceğiz.
The family is both a place of peace, tranquility, love and self-sacrifice, and a place where education and training of new generations are provided. Societies that cannot protect the family, which is the foundation and the smallest building block of society, are doomed to disintegration and disappear. Marriage, which is the only way to create a family in Islamic law, is accepted as an innate need and encouraged. In Islam, it is aimed to establish marriage on the basis of continuity and happiness, not random and temporary. In order to ensure the continuity of the family, temporary marriages are prohibited on the one hand, and on the other hand, some measures and provisions are envisaged before the marriage, during the marriage, before, during and after the divorce. Although it is aimed to create a family for happiness and continuity, sometimes there may be conflicts and disagreements in family life. In these conflict situations, divorce should not be resorted to immediately without a legitimate reason, divorce should be seen as a last resort, and the measures foreseen for the settlement of disputes and the continuation of the marriage should be implemented. Divorce, which is resorted to as a last resort, should not be a solution that ends the marriage irreversibly in the future, but should be done in a way that will give the spouses the opportunity to think and return to the married life depending on regrets in the future. Since we examined premarital measures for the continuity of the family in a previous report, in this article, We will examine the measures during marriage, before divorce, during and after divorce.
