Fukaha arasındaki ihtilaflar naslardan ve bu nasların anlaşılmasını sağlayan dilsel verilerin farklı yorumlanmasından kaynaklanabilmektedir. Bundan dolayı dilsel ifadelerin bağ-lamı, kapsamı, delaleti ve istimali fukahanın fikir ayrılıklarına zemin oluşturmuştur. Fakihlerin zihinsel ayrışmalarındaki önemli konulardan birisi de hurûfu’l-meʻânî bahsidir. Hurûfu’l-meʻânî (edatlar) her bir müçtehit tarafından kendi sistematiği içerisinde farklı telakki edilmiş ve ona göre hüküm belirlenmiştir. Hurûfu’l-meʻânî bahsi usul eserlerinde genişçe yer almış ve bu edatlardan kaynaklanan ihtilaflara eserlerde işaret edilmiştir. Hanefî mezhebinin kurucu imamları arasında da hurûfu’l-meʻânînin farklı yorumlanma-sından kaynaklanan fikrî ayrılıklar meydana gelmiştir. Hanefî mezhebinin önde gelen simalarından birisi de İmam Züfer’dir. Onun Hanefî mezhebinde mutlak içtihat seviyesini haiz olduğu belirtilmiştir. Onun bu durumu kendine özgü hüküm istinbat mekanizmasının olduğunu kabul etmeyi gerektirmektedir. Bu kabul, fıkhın her alanında geçerlidir. Dolayısıyla edatlar bahsinde de onun metodolojik ihtilafları görülmektedir. Söz gelimi gaye-mugayya meselesi bu bahsin akla gelen ilk örneklerindendir. Ayrıca fıkhi ihtilaflar da bu durumu açıkça göstermektedir. Bu makalede Hanefî mezhebi imamlarından İmam Züfer’in hurûfu’l-meʻânîden kaynaklı ihtilafları ele alınmakta ve diğer imamlardan ayrıldığı noktalara işaret edilmektedir.
Differences between Fukaha can be caused by different interpretations of the language data that enable this to be understood. Therefore, the context, scope, delay, and optimism of linguistic expressions formed the ground for the differences of ideas of the fukahan. One of the important issues in the mental divisions of the poor is the Huruf’l-Me’an. The Qur’an says that every one of them has the right to do so, and every one has the right to do so, and every one has the right to do so. In the words of the Prophet (peace and blessings of Allah be upon him), the Qur’an was revealed in the words of the Prophet (peace and blessings of Allah be upon him) and the words of the Prophet (peace and blessings of Allah be upon him). In this article, Hanefî mezhebi imam Imam Züfer's disputes arising from huruf'l-me'anî are discussed and pointed out to the points where the other imam is separated.
The difference between the fuqaha may be due to the text (nass) as well as the linguistic reasons that enable the text to be understood. The context, scope, indication, and usage of linguistic expressions have formed the basis for disagreements of the fuqaha. One of the important issues in the mental separation of the jurists is the talk of hurūf al-maʿānī (prepositions). Prepositions were considered differently by each mujtahid within their system and decided accordingly. The subject of ḥurūf al-maʿānī (prepositions) has taken place widely in his works and the conflicts arising from these prepositions have been pointed out in the works. One of the leading figures of the Ḥanafī sect is Imam Zufar. It is stated that he has the level of absolute ijtihad in the Ḥanafī school. This situation necessitates accepting that it has a unique judgment mechanism. This acceptance is valid in every field of fiqh. Therefore, its methodological disagreements can be seen in the subject of prepositions. For example, the issue of aim and what the purpose includes (gaye-mugayya) is one of the first examples of this issue that comes to mind. In addition, the legal disputes clearly show this situation. In this article, the disagreements of al-ImāmZufar, one of the imams of the Ḥanafī sect, originating from hurūf al-maʿānī are discussed and the points where he differs from other imams are pointed out.
