Fıkhî hükümlerin büyük çoğunluğunun zannî delillerden çıkarıldığını ve zann-ı gâlib üzerine bina edildiğini söylemek mümkündür. Zannî delillerden biri de haber-i vâhiddir. Ha-ber-i vâhidin kabulüyle ilgili olarak mezhepler ve hadis âlimleri tarafından farklı şartlar öne sürülmüştür. Bu bağlamda Hanefi fakihleri haber-i vâhidin bir delil olarak kullanılması husu-sunda diğer fakihlerden daha fazla şart aramışlardır. Bunlardan biri kıyasa muhalif olan ri-vâyetlerde râvinin fakih olması, diğeri ise toplumun tamamını ilgilendiren bir mesele hakkın-da (umûmu’l-belvâ) vârid olan rivayetlerin tevâtür veya meşhur seviyesinde nakledilmesidir. Bu şartların bulunmaması ise bazı Hanefi fakihlerine göre rivayetin amel edilmeme gerekçe-sidir. Buna karşılık kurucu imamların konuya dair görüşlerine bakıldığında bu iki şartın bir ret gerekçesi olmasından ziyade bir tercih sebebi ve kriteri olarak kullanıldığı görülmektedir. Nitekim konuyla ilgili fıkıh usulü literatüründe sunulan örnekler incelendiğinde kurucu imamların bunları mezkûr iki şarttan dolayı reddetmedikleri, ancak söz konusu rivayetleri tercih kriterlerine göre kullandıkları müşahede edilir. Dolayısıyla bu iki şart Hanefi haber teo-risinin kurucusu İsâ b. Ebân tarafından bir kriter olarak belirlenmiş ve sonraki usul literatürü de bu görüş üzerinden şekillenmiştir.
A great majority of juridical rulings are based on an assumption of truth. One of the assumptive evidence is isolated tradition. There are different conditions asserted by madhabs and hadith scholars in terms of ac-cepting isolated tradition. In this context, Hanafi methodologists and jurisprudents have put some conditi-ons for isolated tradition in order to have a reason in practice. One of these conditions is that the transmit-ter of hadith needs to be a faqih in transmitting hadiths that are in conflict with Qiyas (Analogy) and the other one is that the transmitter needs to transmit a hadith, at the level of mutawatir and mashhur in an issue that concerns the whole society. According to some Hanafi scholars, the hadiths that don’t meet these conditions are the cause of rejection. On the other hand, when we look at the opinions of founding imams, these two conditions are used as the reason and criteria for preference rather than a reason for rejection. Thus, when the examples regarding this topic are studied in juristic literature, it is understood that the fo-unding imams have not used the two conditions for rejection, on the contrary, they have used the conditi-ons with their criteria for preference. Therefore, these two conditions came in sight with the founder of Khaber (Report) Theory of Hanafi Isa b. Aban and the juridical literature after that shaped upon this view.
