Abstract:

In criminal proceedings, the prosecutor is the authority that conducts the investigation and conducts the claim activity on behalf of the public in the trial. In this context, he has an important role in criminal procedure. Although there are many monographs and articles about prosecutor, the discussions about his legal status, party position and the burden of proof are still being topical. In this study, an examination of the prosecutor is carried out by taking these controversial issues mentioned in the center. The basic method used during the study is the way of putting our own opinion in the cause-effect relation by taking advantage of the different opinions in the literature
