Anayasa yargısı anayasacılık hareketlerinin bir sonucu olarak, anayasanın üstünlüğünün koruması ve temel hak ve hürriyetlerin güvence altına alınması amacıyla oluşturulmuştur. Bu amaçtan hareketle esas misyonu kanunların anayasaya uygunluğunu denetlemektir. Böylelikle anayasaya uygunluğun yargısal denetimi yapılarak temel hak ve hürriyetlerin güvence altına alınması sağlanmaya çalışılmaktadır. Ancak anayasa yargısının bu misyonu özelinde demokratik meşruluk tartışmaları vardır. Bu tartışmaların temelinde yatan görüş ise, seçilerek görev yapan meclislerin yapmış olduğu kanunların, yargı organı tarafından iptal edilebilme olasılığıdır. Türkiye’de de doktrinde tartışılan bu durum anayasa yargısının demokratik meşruluğunun değerlendirilmesi açısından öne çıkmaktadır. Bu çalışmanın amacı da bu değerlendirmeyi karşılaştırmalı hukuk çerçevesinde yaparak literatüre katkı sağlamaktır.
The Constitutional Court was created as a result of the constitutional movements, with the aim of preserving the superiority of the Constitution and guaranteeing fundamental rights and freedoms. The main mission of this action is to verify the conformity of the laws to the Constitution. In this way, the constitutional conformity is carried out by the court to ensure that fundamental rights and freedoms are guaranteed. But in this particular mission of the Constitutional Court there are discussions of democratic legitimacy. The foundation of these discussions is the possibility that the laws made by the parliaments who are elected by their functions may be cancelled by the judicial body. The situation discussed in the doctrine in Turkey also stands out in terms of the assessment of the democratic legitimacy of the constitutional justice. The aim of this study is to contribute to literature by making this assessment in a comparative legal framework.
