Abstract:

The enforcement of court decisions regarding custody and establishing a personal relationship with the child (contact order) is a very current issue due to the new changes introduced by the Turkish legislator. The system regarding enforcement of custody and contact orders has been amended with Code no:7343. The practice within the framework of the provisions of the Enforcement and Bankruptcy Code, which has been heavily criticized for a long time, has come to an end. In accordance with the new provisions added to Child Protection Code and Turkish Civil Code, a new system has been developed that aims to better protect the best interests of the child. In our study, the reason for the need for legislative changes and the emergence of the new system are discussed. In order to shed light on the system developed in Turkish law, how the issue is handled in foreign laws, the foreseen measure and sanction mechanisms are included. Finally, it is thought that, although the fundamental innovations brought by the Law No.7343 have positive aspects in general, how effective the system can be in protecting the best interests of the child can only be evaluated most conveniently with the developing practice.
