Bir toplumun sosyal ve kültürel birikim sürecinde sanat ve sanatsal alandaki çalışmalar büyük önem taşımaktadır. Sanatçılar, yaratıcı ve eleştirel bakış açısı ile sosyal yapıyı felsefi bir perspektiften değerlendirerek toplumun ilerlemesinde önemli bir rol oynamaktadırlar. Günümüzde sanata gereken önemi veren olan toplumların sosyal, kültürel ve endüstriyel alanda da ilerleme kaydettiğini söylemek mümkündür. Toplumların sosyal ve kültürel birikimlerinin sembolik yansıması olan sanat bu yönüyle, toplumsal politikaların yönlendirilmesi ve şekillenmesine de katkı sunmaktadır. Sanatın ve sanatçının bir toplumsal yapıda yer aldığı konum, o toplumsal yapıdaki duyarlılık ve demokrasi bilinci bakımından bir gösterge niteliği taşımaktadır. Bu çalışmada, sanatçıların çalışma yaşamına ilişkin durum ve koşullarının belirlenebilmesi için, sanatçı çalışmalarının farklı ve özgün yanları ortaya konulmuş, örnek uygulamalar incelenmiş ve bazı verilere sunulmuştur. Sanatçıların mevzuat ve uygulamadan kaynaklanan sorunlarının tespit edilebilmesi için, öncelikle sanatçıların çalışma ilişkilerinin özellikleri ile tipik çalışmalarla benzerlik ya da farklılık taşıyan yönlerinin belirlenmesi gerekmektedir. Bu sayede, konuya ilişkin olarak gerek idari gerekse hukuksal bağlamda yapılacak çalışmalara ve üretilecek çözümlere katkı sunulması amaçlanmıştır.
In the process of social and cultural accumulation of a society, work in the art and art fields is of great importance. Artists play an important role in the progress of society by evaluating the social structure from a philosophical perspective from a creative and critical perspective. It is possible to say that today the societies that give art the necessary importance are also making progress in the social, cultural and industrial fields. The art, which is a symbolic reflection of the social and cultural accumulations of societies, contributes in this direction to the guidance and formation of social policies. The position of the art and the artist in a social structure is an indicator in terms of sensitivity and democracy consciousness in that social structure. In this study, in order to determine the conditions and conditions related to the work life of the artists, the different and original aspects of the artistic work were revealed, examples of practices were studied and some data was presented. In order to identify the problems arising from the legislation and application of artists, it is necessary first to identify the characteristics of the artists’ work relationships and the aspects that are similar or different to the typical works. Thus, it is intended to contribute to the work to be done in an administrative or legal context and to the solutions to be produced.

In order to determine the problems of the artists arising from the legislation and practice, first of all, it is necessary to determine the characteristics of the working relationships of the artists and the aspects that have similarities or differences with typical works. In this way, it is aimed to contribute to the work to be done and the solutions to be produced in both administrative and legal contexts.
