So many results that aren't mine?

Avrupa insan hakları sözleşmesi ve mahkemesi kararlarında mükellefin suç ve cezalara ilişkin hakları

Abstract:

Bu çalışmada, mükellefin suç ve cezalara ilişkin olan haklarının Avrupa İnsan Hakları Sözleşmesi ve Avrupa İnsan Hakları Mahkemesi kararları çerçevesinde korunması incelenmiştir. Suç ve cezalara ilişkin haklar(örneğin suç ve cezaların kanuniliği ilkesi) maddi ceza hukuku bakımından yerleşik ve vazgeçilemez kurallar olmakla birlikte, bunların insan hakları bağlamında birer mükellef hakkı olarak kavramsallaştırılması yeni sayılabilir. Bu nedenle vergi cezaları bakımından da temel olan söz konusu hakların ele alınması faydalı olacaktır.
