Hakem aracılığı ile uyuşmazlıkların çözümü, hukuk sistemlerinin kurulmasından önce ortaya çıkan bir yöntemdir. Günümüz hukuk sistemleri bazı sınırlar dahilinde taraflar aralarındaki uyuşmazlığın hakem aracılığı ile çözülmesine müsaade etmişlerdir. Bazı uyuşmazlıkların hakem aracılığı ile çözülmesinin yargının yükünü hafifletmek başta olmak üzere birçok faydası vardır. Türkiye’de milli tahkim Hukuk Muhakemeleri Kanunu 407-444 maddeleri arasında düzenlenmiştir. Tahkim konusunu düzenleyen maddeler incelendiğinde uyuşmazlığın çözümünde farklı hukuk kurallarının kullanılmasına engel bir düzenlemeye rastlanılmamaktadır. İslam hukuku, bünyesinde hukukun her alanına ilişkin hükümler barındıran, dünya tarihinde 1400 yıldır var olmuş ve bazı devletler tarafından hukuk sistemi olarak kabul edilerek uygulanmış müstakil bir hukuk sistemidir. Dünyada bazı ülkelerde tahkim yolu ile uyuşmazlıklar çözümlenirken İslam hukuku kuralları uygulanmaktadır. Türk Hukukunda tahkim vasıtasıyla uyuşmazlıkların çözümünde İslam hukuku kurallarının uygulanmasına bir engel bulunmamaktadır.

When the articles regulating the issue of arbitration are examined, there is no regulation preventing the use of different legal rules in there solution of the dispute. Islamic law is a self-contained legal system that contains provisions in every field of law, has existed in the world history for 1400 years and has been accepted by some states as a legal system. In some countries around the world, while resolving disputes by arbitration, Islamic law rules are applied. In Turkish Law, there is no obstacle to the application of Islamic law rules in the settlement of disputes through arbitration.
