Abstract:

The Presidential Decision No. 85 on the Amendment to Decision No. 32 on the Protection of the Turkish Currency Value came into force on 13.09.2018. The President's decision has prohibited the obligation to pay with foreign currency in terms of certain types of contracts; it has been foreseen that the price agreed from the currency in the contracts in force, previously agreed within thirty days from the date of force of the decision, will be re-defined by the parties as the Turkish currency. The Ministry of the Treasury and Finance issued notifications on the implementation of the Presidential Decision, with exceptions to the fact that the price of the contract was not agreed in foreign currency or in foreign currency. One of the contracts between these contracts is business/service contracts. Our study will first examine whether the terms of the business and service contracts used in the Decision are used in the same sense, then the scope of the prohibition in which the business contracts are subject to the prohibition in accordance with the Decision and the Notifications issued on the basis of this will be assessed in terms of the content of the prohibition.
