This article deals with the liability of the surety ensuring the payment of the obligations of the tenant in the light of the decisions of the Turkish Court of Appeals. The surety of lease contract continues as a problem for surety and landlord because of unpayment of the rent by the tenant. This problem also exists when not only the rent is not paid, but also when electricity and water bills are not paid. Under these circumstances, the landlond can apply both to the surety and to the tenant for the payment of the rent and other costs. Therefore, the scope of liability of surety in the lease contract should be determined
