Abstract:

Terrorism used by terrorist organizations as an illegal fighting strategy is defined as "crime" in all national and international legal regulations. At political, ideological, religious and ethnic grounds, terrorist activities have been more clearly condemned by international platforms and governments in recent years and are not considered to be a legitimate activity. In Turkey, the fight against terror is carried out in the framework of the Constitution, the Criminal Law and the Anti-Terrorism Act and other laws. The provisions imposing sanctions on the stage of organizing terrorist crimes are regulated in Article 314 of the Criminal Code and Article 7/1 of the Anti-Terrorist Act. The terrorist activities in Southeast Anadolu, which were based on the 1980s, concentrated in 2016 and caused major destruction in Nusaybin. The first area was closed for about four months and six neighborhoods were completely destroyed. A lot of people are homeless. In Nusaybin, where border trade is intense, there are significant clues that the increase in terrorist incidents has led to a decrease in commercial activities. This study analyzed whether terrorism affects Nusaybin’s trade and the impact on small and medium-class in the region. The research has found that with the end of terrorism, migration and unemployment will decrease, and trade will resume.

The provisions that put sanctions on organizing phase of terror crimes are regulated in the article 314 of Criminal Act and article 7/1 of Counter Terrorism Act.
