Özet:

Although the European Court of Human Rights has accepted that freedom of expression is the fundamental principle for the development of democratic societies and for personal development, we can also see from the European Convention of Human Rights and from judicial precedents that these freedoms are not unlimited. However, foreseeable limitations were held subject to a very strict supervision and their limits were again determined by some principles. In this study we have planned to discuss the situations when freedom of expression could be restricted in accordance with the 2nd paragraph of Article 10 of the European Convention on Human Rights, regulating these restrictions. Therefore, the 1st paragraph of the same Article which regulates the scope of freedom of expression has been excluded in this study. In an effort to explain where the constraints of diclosing opinions start and where they end by using sample cases, with this study, we aim to shed light on the implementation in our country where many persons, especially journalists and writers, were held subject to criticisms and investigations
