Bu makalede takdirî durumun genel tanıtımı hedeflenmiştir. Olguya ilişkin teorik çalışmalar Hanefî ekolü dışında yapılmıştır. Bu çalışmalardaki tanımlar, kullanılan tabirler ve örnekler incelenerek olguya yönelik genel Hanefî yaklaşımı tespit edilmeye çalışılmıştır. Takdirî durumun mahiyetine ilişkin tespitlerimizde Bedâi‛u’s-sanâi‛nin önemli bir etkisi bulunur. Zira takdirî durum bu eserde gayet yoğun ve etkin kullanılır. Bu sebeple Kâsânî’nin yaklaşımı merkeze alınmıştır. Bu kapsamda olgu “takdirî durum” tabiri kullanılarak şöyle tanımlanabilir: Şer’î bir hükmün müteallakı olan mevcutlara dair belirsizliklerin giderilmesi ve hükme konu olan şeye ilişkin gerçekteki durumun meşru gerekçeler uyarınca bulunduğundan farklı bir konumda değerlendirilmesidir.
